1. Introduction
This website is owned and operated by Zarity Health Private Limited (“Zarity”, “we”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our mobile application and related services (collectively, “Services”). By using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
Note: Zarity’s website is informational only. All care services, including consultations and memberships, are provided exclusively through our mobile app.
2. Nature of Services
Zarity is a digital health platform that enables registered healthcare providers to offer consultations and long-term chronic care to patients via digital tools. Zarity is not a hospital, does not provide emergency care, and is not a substitute for in-person clinical services. Our services may include:
Teleconsultations with medical practitioners
Diagnostic bookings via partner labs
Integration with CGM devices
Physiotherapy and nutrition care
Zarity facilitates these services and provides supporting technology, but does not control or interfere with the medical judgement of any healthcare provider.
3. Eligibility and User Access
You must be of legal age in your jurisdiction and have the authority to enter into a binding agreement to use our Services. Access to services is limited to:
Users who register via the Zarity mobile app using their verified mobile number
Individuals or corporate members availing services on behalf of employees or dependents
You must not use the app in violation of any applicable law or regulation.
4. Health Data and Consent
By creating an account and uploading any personal or health-related data, you confirm that:
You have the right to share such data
You provide Zarity and your assigned care team with explicit consent to process, store, and use this data to deliver services
All uploaded data will be handled in accordance with Zarity’s Privacy Policy
5. Appointments, Pricing and Payments
When booking a service or consultation, you enter into a contract with the assigned provider through the Zarity platform.
All prices are displayed in the mobile app. We reserve the right to update them at our discretion.
Payments are processed via third-party gateways such as Razorpay. We do not store your financial data directly.
Refunds, if applicable, are processed on a pro-rata basis depending on the stage of service utilisation.
6. Service Limitations and Emergency Care
Zarity does not provide emergency medical services. For any medical emergency (including accidents, assault, or critical symptoms), please contact your nearest hospital or emergency service provider immediately.
Teleconsultation services are provided with full consent of the user and are subject to the limitations of digital health delivery. In-person visits may be required and will be recommended by your care provider where necessary.
7. Intellectual Property
All content, software, branding, and digital assets provided via our Services are the exclusive property of Zarity Health Private Limited. You may not reproduce, distribute, or create derivative works from our intellectual property without prior written permission.
By uploading content (documents, text, images, etc.), you confirm that you hold necessary rights and consent to Zarity using that content to deliver services.
8. Account Suspension or Termination
We reserve the right to suspend or terminate your access to the Services (with or without notice) if:
You breach these Terms
Your activity risks harm to other users, providers, or our platform
You may request cancellation of your account at any time by contacting us at care@zarity.health.
9. Communication and Consent
By registering your phone number or email address with Zarity, you consent to receive:
Service-related communications (e.g., appointment reminders)
WhatsApp messages, SMS, and emails for care delivery and support
Occasional promotional messages (opt-out anytime by writing to care@zarity.health)
10. Indemnity
You agree to indemnify and hold harmless Zarity Health Private Limited and its affiliates, officers, and partners from any claims, losses, or liabilities arising out of:
Your use of the Services
Your violation of these Terms or applicable law
Any claim by a third party related to your use of our platform
11. Limitation of Liability
To the extent permitted by law, Zarity shall not be liable for:
Indirect, incidental, or consequential damages
Medical decisions made by healthcare providers using our platform
Data breaches arising from third-party services or unauthorised access despite reasonable safeguards
12. Modifications to Terms
We may revise these Terms at any time. Material changes will be notified through the app or via email. Your continued use of the Services after such updates signifies your acceptance of the revised Terms.
13. Dispute Resolution and Governing Law
These Terms are governed by the laws of India, with exclusive jurisdiction in Bengaluru, Karnataka.
In case of a dispute, the parties agree to resolve the matter through binding arbitration seated in Bengaluru, conducted in English, in accordance with the Arbitration and Conciliation Act, 1996. Each party shall bear its own legal costs.
